Conditions

The harbor activities in Malmö port must, according to the Swedish Environmental Code, be carried out in compliance with the environmental permit, which has been obtained from the national environmental authorities. The permit contains a number of conditions and the conditions which are currently relevant are listed below. All activities within the harbor, whether managed by CMP or not, must comply with the conditions. Violation of the conditions may lead to criminal responsibility or economic sanctions. CMP reserves the right to claim compensation from any company violating the conditions.

Emission to water

5 Quays and other areas within the port area must be kept clean by sweeping or other treatment of equivalent effect, after any handling of all types of cargo that has either caused dust or can contaminate storm water. The surfaces shall be cleaned regularly if handling of such goods lasts for several days. The Environment Inspection Committee decision of 19 June, 2008
6 Oily wastewater within the Oil Harbour shall be directed to the Company's system for oil-contaminated water (OFA). The ruling of the environmental court of 16 June, 2009
7 Water within the Oil Harbor containing substances that are not gravimetrically separable, shall not be diverted to the OFA system, but must be disposed of as waste. The Environment Inspection Committee decision of 19 June, 2008
13 Wastewater containing more than 50 mg per liter of oil contamination (analyzed as oil index of water) must be purified in a Class 1 type oil separator. The Environment Inspection Committee decision of 19 June, 2008
14 Cleaning water (including water from the cleaning machines) that is led to the public sewage system may contain the following maximum levels (amount per liter) as a guideline value:
Oil (as oil index in water) 50 mg
Copper (Cu) 0.5 mg
Zinc (Zn) 0.5 mg
Lead (Pb) 0.05 mg
Chromium (Cr) 0.05 mg
Nickel (Ni) 0.05 mg
Cadmium (Cd) 0.5 µg
Mercury (Hg) 0.5 µg

15 Chemical products and hazardous waste must be managed in ways that prevent spills and leaks to reach the sewers or the environment. Storage shall take place on a surface that is impermeable to the substance in question, equipped with embankment or other structure to protect against emissions and otherwise designed so that rainwater does not accumulate. The collection volume in each area should be at least equal to the volume of the largest container plus ten percent of the volume of the remaining containers. 35 The content of oil in storm water, which arises in port operations and diverted to the recipient (including water from the OFA facility) may not exceed 5 mg per liter, measured as oil index. The condition is to be verified by measurements according to frequency as stated in the control program, but at least twice annually. The Environment Inspection Committee decision of 20 June, 2013
U1 During the probation period CMP shall investigate a solution for the management and treatment of storm water within Swede Harbor in order to minimize emissions of pollutants to the recipient. The inquiry shall consider that the habitat for the green toad may not be adversely affected. CMP will continue to report the cost of the measures and investigate the possibilities to participate in the coordinated recipient monitoring program. Suggested measures and conditions will be derived from the recipient's sensitivity, both biologically and chemically, the effluent pollution and flows. CMP will also present a proposal on the future control of outgoing water and the control of the impact of emissions on the surrounding environment with suggestions on sampling method, sampling frequency and methods of evaluation of the conditions. Handling and storage

18 There must be designated parking areas for vehicles and containers containing dangerous goods. The Environment Inspection Committee decision of 19 June, 2008

20 Any loading and unloading of ships in the Oil Harbor must be monitored. If need be, the option to shut off the relevant portion of the basin with booms or similar equipment, must be available should spill occur. The ruling of the environmental court of 16 June, 2009
21 Scrap thought to contain emulsions or cutting fluids shall be stored under roof on a surface that is impermeable to the relevant substances and with drainage to a closed system, or in closed containers. The Environment Inspection Committee decision of 19 June, 2008
34 CMP may not store environmentally harmful goods in other parts of the harbor area than the Swede Harbor and the Oil Harbor. The Environment Inspection Committee decision of 20 June, 2013

Waste and recycling

23 Waste generated in the course of the operations and that is collected from vessels must be collected and stored separately in order to facilitate a most environmentally sound further treatment. The waste should, to the largest extent possible, be reprocessed, reused, or exploited in other ways. The Environment Inspection Committee decision of 19 June, 2008

Noise pollution

29 Noise from the operations may not give rise to higher equivalent sound levels outdoors in residential areas than: 57 dBA during the day (hours 06-18),
57 dBA in the evening (hours 18-22) and
50 dBA at night (hours 22-06)
all days of the week and year. The values may be exceeded no more than ten times a year due to malfunctions, breakdowns or similar events. On these occasions, the activity must not give rise to higher equivalent sound level outdoors in residential areas than 60 dBA during the day (hours 06-18), evening (hours 18-22) or at night (hours 22-06).

30 Momentary noise may not exceed 70 dBA outdoors in residential areas at night (hours 22-06) all days of the week and year. The condition relating to momentary noise shall be considered contained even if it is exceeded, but not by more than ten noise events per week. 31 The specified limit for noise should be controlled by nuisance measurements (sw. immissionmätningar) or close circuit measurements (sw. närfältsmätningar) and calculations. Monitoring should be in accordance with the Environmental Protection Agency method regarding nuisance measurements (sw. immissionmätningar) or the closest appropriate whenever there are changes in operations that may lead to increasing noise levels or where the supervisory authority so requests, but at least once every three years. CMP shall within the framework of the control program actively work to fix and eliminate momentary noise incidents, especially if they occur at night. Differentiated harbor fees

32 CMP shall work to develop the differentiated harbor fees so that they increase the incentives for environmental improvement measures on ships operating in the harbor. CMP shall, each year in the environmental report, account for the different tariffs applied and the changes that occurred during the year covered by the report.
